EXPLOSIVES/ Do you wish to obtain License/NOC for any of the following

1. Permanent Firecrackers shop?

Point to Remember:-

  1. 1. If you are contemplating selling only amorces & sparklers upto 100 Kilograms then you do not require a license (However, all the conditions/safety measures must be observed as per Explosives Rules-2008 in the interest of public safety at large).
  2. But if you want to sell mixed crackers (amorces, sparklers & other crackers) even upto 100 Kilograms or a higher quantity then it is mandatory that you apply for a fireworks license. The permanent fireworks licences are to be granted by Additional Commissioner of Police, Licensing, Delhi upto a quantity of maximum of 100 kg of manufactured fireworks fireworks (Division-2, sub-division-II as per Schedule I of Explosive Rules, 2008, which comprises high hazard fireworks like rocket shells, maroons, wheels, barrages, fountains, illumination pieces, distress signals, etc) and 500 kg of Chinese crackers/ sparklers (Division-2, sub-division-I as per Schedule I of Explosive Rules, 2008, which comprise low hazard fireworks like sparklers, Chinese crackers, serpents etc.).

The licences for quantity exceeding 100 kgs of manufactured fireworks and 500kgs of Chinese sparklers/crackers are granted by the Joint Chief Controller of Explosive, Faridabad Haryana after receipt of No objection certificate issued by the Addl. Commissioner of Police, Licensing Delhi.

General conditions (for Permanent Fireworks Licences as well as No Objection Certificate):-

  1. Licences shall be granted only for a shop located on a commercial street or in a commercial shopping centre, as per the Master Plan Delhi- 2021 in accordance with Section 15.5 & 15.6.2 and 15.6.3. The list of notified commercial areas is given in supplement to MPD-2021, which is available in any book shop.
  2. Minimum floor area required is 9 sq. metres and maximum floor area is 25 sq. metres.
  3. No person below the age of 18 years and no person who is addicted to intoxication or of unsound mind shall be granted a licence.
  4. The shops shall only be located on the ground floor of a building completely separated from other parts of the building by substantial walls.
  5. The shop shall not be situated in the sub level or basement or mezzanine floor.
  6. The shop shall not be situated under the upper floor used for the purpose of dwelling.
  7. The shop shall not be situated under or nearby any staircase or lift.
  8. The licenced premises must have an independent entrance and exit. However, in Babu Lal and Others Vs DCP Licensing and others, the Hon’ble Supreme Court of India has ruled -  “Normally shops have an opening which is used both for entry and exit - that it does not open into any other premises is what is important so that in event of any difficulty there is a way out.”
  9. The shops should have doors opening outwards.  Alternatively, the doors may be provided with rolling shutters, but the same must be provided with stoppers, which must be functional.
  10. The road width in front of the shop must be a minimum of 12 metres, thus making it accessible for fire fighting.
  11. The shop shall be at a distance of minimum 15 metres from any shop or premises used for storage of similar explosive, flammable or hazardous materials.
  12. The shops should have no electrical apparatus or battery or oil lamp or similar equipment capable of producing spark or ignition and all electrical wiring in the shop should be fixed and effectively sealed or conduited or mechanically protected. The main switch or circuit breaker should be provided at the immediate accessible position outside the premises. 

Documentation to be submitted for obtaining License/NOC (All in 5 Sets):-

  1. Application form (Click to Download)
  2. Notarised affidavit (Click to Download)
  3. Two photographs of the applicant, which are self attested.
  4. Site plan of the premises:- The site plan should clearly show the approach road, electric wiring network, nearby structures and distances from nearby protected works as well as telephone junctions, transformers etc.
  5. Four photographs of the premises (5X7 inches) from different directions depicting the   clearance from adjoining shops/premises and other shops of similar nature.
  6. Proof of residence.
  7. Proof of ownership of the proposed shop.
  8. In case of a rented shop, NOC from the landlord along with the rent agreement on the affidavit duly attested by the notary public/civic agency with photographs of the landlord and the tenant.
  9. A scrutiny fee of Rs. 200/- in cash (non-refundable) payable to the Addl. Commissioner of Licensing, Delhi at the cash counter of Licensing Unit.

The application form for the permanent fireworks licences shall be available free of cost in the office of Additional Commissioner of Police, Licensing, Delhi in the prescribed format. It shall also be made available for download on the website of Delhi Police Licensing Unit. The application form duly filled along with all the required documents will be submitted at the Office of Additional Commissioner of Police, Licensing.

Procedure for grant of licence:-

  1. The following NOCs shall be sought to adjudge the suitability of place and applicant to carry out the trade:-
    1. NOC from Fire Department:-   to ascertain suitability of place from fire safety point of view in the interest of public safety at large and availability of the fire safety arrangements.
    2. NOC from Land owning agency:- like MCD/DDA/NDMC/ DUSIB/Delhi Cantonment Board to ascertain that the location of the shop/premises in    the Commercial Street or commercial shopping centre as per Master Plan Delhi-2021 or any objection, if any, from municipal by-laws/land regulation  point of view as per Annexure-F.
    3. NOC from Local Police: - to ascertain suitability of the site from law and order point of view, verification of the character and antecedents of the applicant and verification of the documents submitted by  the applicant on the proforma (Annexure-D).
  2. After receipt of above reports, inspection of the premises shall be conducted by an officer of the Licensing unit as per Annexure-E.
  3. The licence after due approval shall be issued as per Annexure-G, which may be up to 5 years.  Alicence fee of Rs 500/- per annum shall be charged while granting the licence.
  4. A copy of the licence along with approved drawings granted by the office of Additional Commissioner of Police, Licensing,   Delhi shall be forwarded to the Joint Chief Controller of Explosives, Faridabad, Haryana as per the Rules (Section 107 (7) of the Explosives Rules-2008.
  5. TheAdditional Commissioner of Police, Licensing while refusing to grant licence shall record in writing the reasons for such refusal and communicate the same to the applicant.  The applicant shall be given an opportunity of being heard before a decision to refuse the licence is taken. (Rule 114 of Explosives Rules, 2008)
  6. Appeal: An appeal against the order of the Additional Commissioner of Police, Licensing, Delhi refusing to grant a licence or suspending or revoking a licence or varying the condition of a licence shall lie, with Special Commissioner of Police, Administration, PHQ who will decide the appeal (Rule 121 & 122 of the Explosives Rules-2008). A fee of Rs. 200/- shall be deposited either in cash or through Demand Draft.  In case the appeal is upheld by the appellate authority, the fee shall be refunded to the appellant.

Procedure for renewal of Licence:-

  1. The licence granted by District Authority (Addl. CP/Licensing) shall be renewed every five years.
  2. Every application for the renewal of licence shall be made so as to reach the licensing authority to renew the licence on or before the date on which the licence expires and if the application is so made, the licence shall be deemed to be in force until an intimation that the renewal of the licence is refused, has been communicated to the applicant (as per Rule 112, of the Explosives Rules-2008)
  3. No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after three months of the date of its expiry.  

Conditions regarding sound pollution:-

The conditions as envisaged under of Explosive Rules, 2008 shall be adhered to by the Licencees and the local police will ensure the same. Apart from the above conditions the following safety measures shall also be ensured:-

The Hon’ble Supreme Court of India in Forum for Prevention of Environment, & Sound Pollution vs Union of India vide order dated 18.07.2005  has ruled that

  1. There shall be a complete ban on bursting sound emitting firecrackers between 10 pm and 6 am. It is not necessary to impose restrictions regarding the time of bursting of colour/light emitting firecrackers.
  2. Firecrackers shall not be used at any time in silence zones, as defined in S.O. 1046 (E) issued on 22.11.2000 by the Ministry of Environment and Forests. In the said Notification, Silence Zone has been defined as: "an area comprising not less than 100 meters around hospitals, educational institutions, courts, religious places or any other area which is declared as such by the competent District DCP.

Do's & Don'ts for licencees and responsibility of local police:-

  1. At least 4 sand bags must be kept in the premises.  Additional sand bags depending upon the size of the premises are also required to be kept.
  2. “No smoking” signboard should be displayed in each licenced premises.
  3. At least two or more fire extinguishers of liquid/water CO2 type of 9 ltrs capacity each of ISI mark should be installed in the premises in sound working condition.
  4. The use of crackers and smoking should not be allowed near the sale area i.e. within 50 mtrs area from the shop.
  5. Fire Hydrants should be located in the selected areas with the help of Licencees.  The Fire Department & Delhi Jal Board may be associated to ensure that the location is satisfactory, adequate water pressure is maintained and is usable when it is required.
  6. Electricity supply companies like BSES/NDPL & Delhi Transco Co. etc. should be requested by the local police from time to time to check overhanging of electricity wires for ruling out the possibility of any short circuit and spark in the areas where fireworks shops are situated.
  7. Fireworks shall not be placed or kept in a shop window used for display of goods.
  8. Fireworks shall be kept in a spark proof receptacle or the original outer pocket in which they were received if that package is effectively sealed and in good order and condition.
  9. A receptacle or package containing fireworks shall be kept in a position away from and clear of shop traffic and to be separated from all articles of a flammable or combustible nature.
  10. Where a package containing fireworks is opened for sale, the fireworks shall immediately be placed in a clean, dust free & spark proof receptacle.
  11. Any additional CFL or decorative lights with loose and hanging wire at the licenced premises shall not be displayed.  
  12. No licencee shall sell the fireworks from the pavement or any place outside of shop.  Neither any licencee shall encroached the pavement or the abutting road with the goods/fireworks boxes of his shop nor will he place any sale counter on the pavement or the road.

2. Temporary Firecrackers shop?

Point to Remember:-

  1. If you are contemplating selling only amorces & sparklers upto 100 Kilograms then you do not require a temporary license (However, all the conditions/safety measures must be observed as per Explosives Rules-2008 in the interest of public safety at large).
  2. But if you want to sell mixed crackers (amorces, sparklers & other crackers) even upto 100 Kilograms or a higher quantity then it is mandatory that you apply for a temporary fireworks license. For selling fireworks upto 600Kg (100 kg of manufactured fireworks of class-7, division-2, subdivision-2 plus 500 kg of Chinese crackers or sparklers) the temporary license will be granted by the concerned district Deputy Commissioners of Police

Applicants for temporary fireworks licence for sale of reduced emission improved (Green) crackers upto 600 Kilograms may either have a ‘pucca shop’ or ‘temporary shed’ meeting the following requirements: -

General conditions (for pucca shops as well as temporary sheds):-

  1. Licences shall be granted only for a shop located on a commercial street or in a commercial shopping centre, as per the Master Plan Delhi- 2021 in accordance with Section 15.5 & 15.6.2 and 15.6.3. The list of notified commercial areas is given in supplement to MPD-2021, which is available in any book shop.
  2. Minimum floor area required is 9 sq. metres and maximum floor area is 25 sq. metres.
  3. No person below the age of 18 years and no person who is addicted to intoxication or of unsound mind shall be granted a licence.
  4. The shop must be located on a minimum of six (06) meters wide clear motorable road (excluding obstructions like electric poles, kerbs, covered drains, pillars, raised pavements etc) with entry and exit facing the road, thus making it accessible for fire fighting.      

However the above condition is not applicable in areas covered under the decision of Hon’ble Supreme Court of India with regard to CWPs No. 499 & 747/93 and 4651/93 and the conditions as per the decision shall be applicable.

Requirements for pucca shop:-

  1. The shops shall only be located on the ground floor of a building completely separated from other parts of the building by substantial walls.
  2. The shop shall not be situated under or nearby any staircase or lift.
  3. Shop must be located on the ground floor of the building and should not be located in sub level or basement or mezzanine floor.
  4. Upper floor should not be a dwelling unit.
  5. Shop should not be within 15 meter distance from any shop or premises used for storage of any explosive, inflammable or hazardous material.

    6. However the above condition is not applicable in areas covered under the decision of Hon’ble Supreme Court of India with regard to CWPs No. 499 & 747/93 and 4651/93 and the conditions as per the decision shall be applicable.

  6. Shop should have no electrical apparatus or battery or oil lamp or similar equipment capable of producing spark or ignition and all electrical wiring in the shop should be fixed and effectively sealed or conduited or mechanically protected. The main switch or circuit breaker should be provided at the immediate accessible position outside the premises.
  7. Shop should have adequate ISI approved fire fighting equipment.
  8. Shop should have independent entrance and emergency exit from open space. Alternatively, shop may have single opening which can be used both for entry and exit, as per the decision of Hon'ble Supreme Court of India in I.A. of 1993 in SLP NO. 17329/93 Babu Lal & Ors. Vs. DCP/Licensing and Ors. However, such entry should be wide enough for easy evacuation and not open into other premises.
  9. Shop should have doors opening outwards. Alternatively, shop may have rolling shutters but the same must be provided with stoppers, which must be functional.

Requirements for temporary sheds:-

  1. The shed should be of non-flammable material. It should be closed and secured so as to prevent unauthorized persons having access thereto.
  2. The sheds should be at a distance of at least 3mtrs from each other and 50 mtrs from any protected works.
  3. The sheds should not be facing each other.
  4. No oil burning lamps, gas lamps or naked lights shall be used in the shed or within the safety distance of the sheds for the purpose of lighting. Any electrical light if used shall be fixed to the wall or ceiling and should not be suspended by flexible wire. Switches should be fixed rigidly near the ceiling and a master switch should be provided for each row of sheds.
  5. Display of fireworks shall not be allowed within 50 mtrs of any sheds.
  6. In one cluster not more than 50 shops shall be permitted.
  7. Temporary sheds shall not be permitted in such open space which serves as the only fall back area for nearby residential or commercial areas. The area for temporary sheds should not be close to any busy market. Temporary sheds should be so located that these do not affect circulation of traffic, contingency evacuation including movement of emergency vehicles and smooth movement of pedestrians. Decision on the above shall be on case to case basis depending upon suitability of place from public security and safety point of view.

Know your rights:-

In case, your application for temporary fireworks license is rejected:

  1. 1 You have right to be heard by the licensing authority before rejection of such application.
  2. The licensing authority has to intimate you in writing and mention the ground of such rejection in the said letter.
  3. You have right to appeal before Joint Commissioner of Police of the concerned range in Delhi along with a fee of Rs. 200/- in cash or through demand draft.
  4. In case appeal is upheld by the appellate authority, the fee shall be refunded to you.

Documentation required to be submitted:-

  3. Site plan of the premises prepared by a registered architect.
  4. Four photographs of the premises (5X7 inches) from different directions depicting the clearance from adjoining shops/premises and other shops of similar nature.
  5. Proof of ownership/tenancy of the premises.
  6. Any other documents as prescribed in the checklist available with the application form.
  7. Site plan of the premises:- The site plan should clearly show the approach road, electric wiring network, nearby structures and distances from nearby protected works as well as telephone junctions, transformers etc.
  8. Two photographs of the applicant, which are self attested.
  9. In case of temporary sheds, copy of application submitted to land owning agency for obtaining its NOC/tehbazari for the temporary fireworks shop.

Application forms will be available at all the police stations and at the Licensing Unit website in Delhi with effect from 27/09/2019.

The application forms (completely filled up) must be deposited with the concern district DCP office by 30/09/2019. The temporary firework license shall be valid only from 06-10-2019 to 29-10-2019 i.e. two days before Dusshera to two days after Deepawali.

3. Storage/Sale of Poison/Acid?

Citizens of Delhi are hereby informed that a license is required to be procured for the possession or Sale of “POISONS/ACIDS” as per schedule A & B of Delhi Poisons Possession and Sale Rules, 2015 as notified vide notification no. F.8/Misc./2012/HP-II/6985-96 dated 25.08.2017. Licensing Authority of Delhi Police shall Grant License for Sale/Possession of any POISON/ACID, as specified in the schedules as per section 2 (C) of the notification

1. For Fresh/Renewal License

Documents required:-

  1. Application on the prescribed form for poison Click to Download / for sulphur license application on plain paper.
  2. Site and Key Plan of the premises prepared by Registered Architect and also undertaking that it will not violate the provision of Master plan 2021.
  3. Photographs of the Premises from all directions depicting the clearance from other shops.
  4. Proof of ownership, residence duly attested by Gazetted Officer.
  5. If the applicant is a Company/Firm, then the copy of agenda/ resolution/minutes issued by the company, registration certificate etc. to be submitted.
  6. Two photographs of the applicant.
  7. Affidavit Click to Download.
  8. Medical Certificate of the Applicant Click to Download.

Procedure to Apply Online: -

  • Kindly keep ready all the documents as per the check list before filling up the online application
  • After submission of the online application form alongwith uploading of documents, you shall submit the Hard Copies (6 sets) of the same within 7 days,during public dealing hours (9.30 am to 05.00 pm), failing which the application will be rejected.

    3. STANDARD OPERATING PROCEDURE FOR LICENSEE

      A standard operating procedure (SOP) outlining the measures undertaken for security, storage and incident management of poisons (chemicals/acids/corrosive substances) and it should be displayed prominently in the premises of the user

        (1)Security of poisons (chemicals/acids/corrosive substances).

        1. (a) A person shall be made accountable for possession and safe keeping of poisons (chemicals/acids/corrosive substances) in the premises.
        2. (b)The storage of poisons (chemicals/acids/corrosive substances)shall be under the supervision of this person
        3. (c) The storage of poisons (chemicals/acids/corrosive substances)shall be under double lock system to ensure more security.
        4. (d) A register of usage of poisons (chemicals/acids/corrosive substances) shall be maintained and the same shall be filed with the concerned SDM every quarter.
        5. (e) There shall be compulsory checking of the students/personnel leaving the laboratories/place of storage where poisons (chemicals/acids/corrosive substances) is used/stored by the lab in-charge/attendant

          6. (2) Storage of poison/chemical/acids/corrosives substances

          1. (a) The Poisons (chemicals/acids/corrosives substances) should be stored in plastic or other suitable containers
          2. (b) All storage containers should be labelled to indicate the identity of the poisons (chemicals/acids/corrosives substances) and the hazards involved and the precautions to be taken.
          3. (c) Incompatible poisons (chemicals/acids/corrosives substances) should not be stored together
          4. (d) The inventory of poisons (chemicals/acids/corrosives /substances) should be kept to a minimum
          5. (e) Protective gloves, aprons, safety glasses and face shields should be worn where appropriate
          6. (f) Acids should be diluted with care- always add acid to water, never add water to acid

            7. (3) Incident Management:

            1. (a) Skin contact: Quickly take off contaminated clothing, shoes and leather goods (e.g. watchbands, belts). Quickly and gently blot or brush away excess chemical. Immediately flush with lukewarm, gently flowing water for at least 30 minutes. DO NOT INTERRUPT FLUSHING. If it can be done safely, continue flushing during transport to hospital. Immediately call a Poison Centre or doctor. Treatment is urgently required. Transport to a hospital.
            2. (b) Eye Contact: Avoid direct contact. Wear chemical protective gloves if necessary. Quickly and gently blot or brush chemical off the face. Immediately flush the contaminated eye(s) with lukewarm, gently flowing water for at least 30 minutes while holding the eyelid(s) open. If a contact lens is present, DO NOT delay flushing or attempt to remove the lens. Neutral saline solution may be used as soon as it is available. DO NOT INTERRUPT FLUSHING. If necessary, continue flushing during transport to hospital.
            3. (c) Ingestion: Have victim rinse mouth with water. If vomiting occurs naturally have victim lean forward to reduce risk of aspiration. Have victim rinse mouth with water again. Immediately call a Poison Centre or doctor. Treatment is urgently required. Transport to a hospital
            4. (d) Inhalation: Take precautions to ensure your own safety attempting rescue (e.g. wear appropriate protective equipment). Move victim to fresh air. Keep at rest in a position comfortable for breathing. If breathing is difficult, trained personnel should administer emergency oxygen. DO NOT allow victim to move about unnecessarily. Symptoms of pulmonary edema may be delayed. Immediately call a Poison Centre or doctor. Treatment is urgently required. Transport to a hospital

            4. Petrol Pump/ CNG Station/ LPG Station?

            1. For grant of license for storage of Petroleum:

            Addl. Commissioner of Police, Licensing is empowered to grant a license to store petroleum in the following categories: -

            1. to store Petroleum Class-A in quantity not exceeding 300 litres.
            2. to store Petroleum Class-B, in bulk quantity not exceeding 25,000 litres.

            (The licensing authority for more than these quantities is the Jt. Chief Controller of Explosives, Faridabad, Haryana.)

            Documents required:

            The applicant shall make an application on Form-IX Click to Download as provided in the Petroleum Rules, 2002 to the Licensing unit (i.e. Addl. Commissioner of Police, Licensing) along with following documents: -

            1. Request letter/application of the applicant.
            2. Land ownership proof/property documents of premises/sale deed/lease deed/allotment deed duly signed by the applicant (6 copies).
            3. Rent agreement/NOC from land lord, in case of tenant.
            4. Site plan/Key plan attested by an authorised architect of the proposed site duly verified by the applicant (6 copies).
            5. A formatted affidavit Click to Download containing general information in respect of applicant on stamp paper of Rs. 10/- along with its necessary enclosures duly attested by the Notary Public and signed by the applicant (6 copies).
            6. In case the applicant is an employee/representative of any firm/company, an authority letter in favour of the applicant or signing authority/person issued by the firm/company.
            7. Memorandum of article of the firm/company.

            Procedure:-

            Application along with required documents can be submitted in the Licensing Unit, on any working day during public dealing hours (9.30 Am to 12.30 Pm).

            2. For issue of No Objection for the grant of license for storage of Petroleum:
            (for quantity more than as mentioned at 1. above)

            Documents required:-

            The applicant shall make an application on Form-IX Click to Download as provided in the Petroleum Rules, 2002 to the Addl. Commissioner of Police, Licensing along with the documents as stated at (1) above and a site plan /Key plan of the proposed site duly approved by the Joint Chief controller of Explosives, Faridabad, Haryana.

            Procedure:-

            Application along with required documents can be submitted in the Licensing Unit, on any working day during public dealing hours (9.30 Am to 12.30 Pm).

            3. For issue of No Objection for the grant of license to dispense CNG:

            Documents required:-

            The applicant shall make an application on Form-G Click to Download as provided in the Gas Cylinder Rules, 2004 to the Addl. Commissioner of Police, Licensing along with documents as stated at (1) above and a site plan/ key plan of the proposed site duly approved by the licensing authority i.e. Chief Controller of Explosives, Nagpur.

            Procedure:-

            Application along with required documents can be submitted in the Licensing Unit, on any working day during public dealing hours (9.30 Am to 12.30 Pm).

            4. For issue of No Objection for the grant of license to dispense LPG:

            Documents required:-

            The applicant shall make an application on Form-I-A Click to Download. as provided in The Static and Mobile Pressure Vessels (Unfired) Rules, 1981 to the Addl. Commissioner of Police, Licensing along with documents as stated at (1) above and a site plan / key plan of the proposed site duly approved by the licensing authority i.e. Chief Controller of Explosives, Nagpur.

            Procedure:-

            Application along with required documents can be submitted in the Licensing Unit, on any working day during public dealing hours (9.30 Am to 12.30 Pm).

            Safety tips:-

            1. The proposed site should not cause risk, danger, damage or annoyance to residents of the locality.
            2. The area should be free from traffic problems and clear from traffic regulation point of view and also the entrance and exit of the site may be convenient, easy, adequate and satisfactory.
            3. There should be adequate space for the movement of vehicles inside the proposed petrol pump/oil installation.
            4. The premises should be safe from fire safety and escape route point of view.
            5. The accessibility of fire tenders to the site in case of emergency is very essential.
            6. The premises or shops, as the case may be, for petroleum storage should not be located near any store or shop dealing with any combustible and inflammable material which could endanger public safety at the site of the such petroleum storage.

            5. Ammonium Nitrate

            Point to Remember:-

            1. As per Rule 2 (b) of the Ammonium Nitrate Rules, 2012, Ammonium Nitrate means the compound having the chemical formula NH4NO3 and includes any mixture or compound having more than 45 percent Ammonium Nitrate by weight including emulsions, suspensions, melts or gels (with or without inorganic nitrates) but excluding emulsion or slurry explosives and non-explosives emulsion matrix and fertilizers from which Ammonium Nitrate can not be extracted by any physical or chemical process.

            2. No licence shall be required for possession and use of ammonium nitrate of quantity not exceeding five kilogram (5kgs) by established laboratories, educational institutions, medical institutions, hospitals and clinics for scientific and educational purposes. However, they must inform local police about the quantity under possession for the foresaid purposes.

            General conditions:-

            Grant of Ammonium Nitrate licences/No Objection Certificate shall be so regulated that no pilferage, fire accidents/incidents resulting in injury and loss of human life takes place. This should be done in accordance with the provisions of The Explosives Act, 1884, The Explosives Substances Act, 1908, The Ammonium Nitrate Rules, 2012 and other conditions as given below:-

            1. Licences shall be granted only for a storehouse located on a commercial street or area as per the Master Plan Delhi- 2021 in accordance with Section 15.5 & 15.6.2 and 15.6.3. The list of notified commercial areas is given in supplement to MPD-2021, which is available in any book shop.
            2. The applicant shall obtain prior approval plan from the authority empowered to grant license by submitting documents mentioned as per rule 33.
            3. The applicant shall be given one set of plans showing distances required to be kept clear as specified in Rule 12 duly endorsed together with approval of Addl. CP/Licensing.
            4. The Ammonium Nitrate storehouse shall not be located in populated area.
            5. The applicant shall at his own expense provide sufficient number of security guards for safe custody of Ammonium Nitrate in the licensed premises.
            6. The premises used for manufacture of the Ammonium Nitrate or conversion of the melt into solid form of Ammonium Nitrate or vice versa and the storehouse shall be surrounded by a wall of at least two metres height of such strength and construction as to effectively prevent entry of unauthorised persons.
            7. Safety distance of 4.5 metres from store house to the compound wall and 45 meters from any protected works shall be maintained for storage house of Ammonium Nitrate not exceeding 30 MT. (Note:- Safety distance shall be measured from the edge of the storehouse)
            8. Safety distance of 9 metres from store house to the compound wall and 90 meters from any protected works shall be maintained for storage house of Ammonium Nitrate exceeding 30 MT. (Note:- Safety distance shall be measured from the edge of the storehouse)
            9. The storehouse may be adjacent to the bagging unit of the manufacturing, conversion or explosives or nitrous oxide manufacturing plants, but shall observe the provisions of clauses at mentioned Sl. No. iv and v above.
            10. The storehouse shall be situated at ground level without any mezzanine floor, upper floor or any basement, with the floor (plinth) level not less than 45 centimetres from the ground level and well ventilated.
            11. The storehouse shall be with at least 23 centimetres thick walls built of bricks or stone mortar or concrete and with roof of RCC or asbestos or Fibre or GI sheet.
            12. The storehouse shall have sufficient number of doors made of steel of minimum three millimetres thickness and opening outwards.
            13. The storehouse of stevedore may be a shed without side walls.
            14. Any storehouse used for possession for sale or possession for use of Ammonium Nitrate shall have a floor area not less than one square metre per Metric Tonne of Ammonium Nitrate and the storehouse total holding capacity shall not exceed 5000 MT storage. One stack of bagged Ammonium Nitrate shall not exceed 200MT and a minimum clearance of two metres shall be maintained between the adjacent stacks and at least 0.6 metre wide gangway shall be maintained between the stacks and the wall of the storehouse.
            15. The maximum stack height shall not exceed 2.5 metres from the floor level and the same shall be prominently marked on the wall of the storehouse.
            16. The storehouse shall be protected against lightning as per IS 2309.
            17. The storage tank meant for storage of Ammonium Nitrate melt shall be constructed of stainless steel and single storage tank capacity shall not exceed 200 MT and the distances of storage tank with respect to the storehouse wall and protected work shall be applicable as in the case of storehouse.
            18. No person below the age of 18 years and who is addicted to intoxication or of unsound mind or who is mentally or physically challenged shall be granted a licence or employed by the licensee.
            19. The road width in front of the storehouse must be a minimum of 12 metres, thus making it accessible for fire fighting.
            20. xx. No toxic, corrosive, or flammable or otherwise dangerous substances such as carbonaceous matter, reducing agents, petroleum, carbide of calcium, compressed gases or any other chemical which may react with Ammonium Nitrate in a manner that may result in an explosion shall be allowed in the premises meant for manufacture, conversion, bagging, storage, import, export, transport or handling of Ammonium Nitrate.

            Documentation to be submitted for obtaining License/NOC (All in 6 Sets):-

            1. Application form (Form No. A-3 as per Rule 33 of the Ammonium Nitrate Rules, 2012) for licence to possess for sale or use of Ammonium Nitrate from a store house not exceeding 30MT or license to possess for use of Ammonium Nitrate for agricultural purposes from a storehouse (Annexure-A, Click to Download).
            2. Application form (Form No. A-4 as per Rule 33) of the Ammonium Nitrate Rules, 2012 for licence to transport Ammonium Nitrate from a store house not exceeding 30MT (Annexure-A1 Click to Download).
            3. Prescribed affidavit along with self attested photographs attested by the notary along with the documents. (Annexure-B, Click to Download).
            4. Safety and Security Management Plan prepared as required under Rule 15.
            5. Drawings of the proposed/existing storehouse and attached facilities and the site showing approach road with all protected works in and around.
            6. Documentary evidence in respect of company or partnership firm or society including list of directors or partners or officer-bearers, as the case may be, including nomination of the authorised signatory with their specimen signatures.
            7. Six passport size photographs of the occupier signed by him in the front along with documentary evidence of nomination as occupier.
            8. Photograph of the premises from all directions depicting the clearance from other storehouse of similar nature and the protected work, if any.
            9. Proof of residence.
            10. Proof of ownership of the proposed storehouse.
            11. In case of a rented premises, a copy of rent agreement alongwith NOC from the landlord on the affidavit (Annexure-M, Click to Download) duly attested by the notary public/civic agency with photographs of the landlord and the tenant.
            12. A scrutiny fee for prior approval of Rs. 1000/- in cash (non-refundable) to be paid at the cash counter of Licensing Unit.
            13. The particulars of persons employed for handling of Ammonium Nitrate, their qualification and experience. The applicant shall file an affidavit (Annexure-B, Click to Download) regarding their character and antecedent.
            14. The certificate of completion of storehouse and attached facilities duly endorsed by a chartered engineer.

            Procedure for grant of licence:-

            1. The application form for the Ammonium Nitrate licences shall be available free of cost in the office of Additional Commissioner of Police, Licensing, Delhi in the prescribed format. It shall also be made available for download on the website of Delhi Police Licensing Unit.
            2. The application form duly filled along with all the required documents will be submitted at the Office of Additional Commissioner of Police, (Licensing).
            3. A register will be maintained listing out the date of receipt of each application and each application has to be given a specific number.
            4. All the documents will be scrutinised as per the Check List (Annexure-C, Click to Download).
            5. The following NOCs shall be sought to adjudge the suitability of place and applicant to carry out the trade:-
              1. NOC from Fire Department:- to ascertain suitability of place from fire safety point of view in the interest of public safety at large and availability of the fire safety arrangements.
              2. NOC from land owning agency:- like MCD/DDA/NDMC/ DUSIB/Delhi Cantonment Board to ascertain that the location of the storehouse/premises in the Commercial area as per Master Plan Delhi-2021 or any objection, if any, from municipal by-laws/land regulation point of view as per (Annexure-E, Click to Download).
              3. NOC from Local Police: - to ascertain suitability of the site from law and order point of view, verification of the character and antecedents of the applicant and handlers and verification of the documents submitted by the applicant on the proforma (Annexure-D, Click to Download).
            6. After receipt of above reports, inspection of the premises shall be conducted by an officer of the Licensing Unit as per (Annexure-F, Click to Download).
            7. All the above reports shall be put up to Addl. CP (Licensing). In case, all the reports are positive, he shall approve the issuance of Licence/NOC as the case may be.
            8. The licence after due approval shall be issued as per (Annexure-G, Annexure-G1, Click to Download) which may be up to 5 years. A licence fee of Rs 2000/- per annum for license to possess for sale of Ammonium Nitrate from a store house and license to transport Ammonium Nitrate shall be charged while granting the licence respectively. A license fee of Rs. 1000/- per year for license to possess for use of Ammonium Nitrate from a store house shall be charged while granting the license.
            9. A copy of the licence along with approved drawings granted by the office of Additional Commissioner of Police, Licensing, Delhi shall be forwarded to the Joint Chief Controller of Explosives, Faridabad, Haryana as per the Rules (Section 36 (8) of the Ammonium Nitrate Rules-2012.
            10. The Additional Commissioner of Police, Licensing while refusing to grant licence/NOC shall record in writing the reasons for such refusal and communicate the same to the applicant. The applicant shall be given an opportunity of being heard before a decision to refuse the licence is taken. (Rule 39 of Ammonium Nitrate Rules, 2012)
            11. Appeal: An appeal against the order of the Additional Commissioner of Police, Licensing, Delhi refusing to grant a licence or suspending or revoking a licence or varying the condition of a licence shall lie, with Special Commissioner of Police, Administration, PHQ who will decide the appeal (Rule 44 and 45 of the Ammonium NitrateRules-2012).

            Procedure for renewal of Licence:-

            1. The licence granted by District Authority (Addl. CP/Licensing) shall be renewed every five years.
            2. Every application for the renewal of licence shall be made so as to reach the licensing authority to renew the licence on or before the date on which the licence expires and if the application is so made, the licence shall be deemed to be in force until an intimation that the renewal of the licence is refused, has been communicated to the applicant (as per Rule 36, of the Ammonium Nitrate Rules-2012)
            3. No licence shall be renewed if the application for renewal is received by the licensing or renewing authority after the date of its expiry.

            Processing time:-

            On receipt of all the required documents, NOCs shall be sought from the concerned department/Units within a week. On receipt of NOC from all the departments/units, inspection shall be conducted within 15 days and final decision shall be taken within a month.

            Do's & Don'ts for licencees and responsibility of local police:-

            1. At least 10 sand bags must be kept in the premises. Additional sand bags depending upon the size of the premises are also required to be kept.
            2. “No smoking” signboard should be prominently displayed in each licenced premises.
            3. Adequate number of fire extinguishers capable of dealing with fire involving electric circuits, with other inflammable components shall be provided in the storehouse/transport of the Ammonium Nitrate.
            4. No person shall commit or attempt to commit any act which may tend to cause to fire or explosion in or about any place where the Ammonium Nitrate is manufactured, converted, bagged, stored or transported.
            5. The premises used for storage of the Ammonium Nitrate shall not be used for storage of any other material including fertilizer.
            6. The license shall maintain a safety and security management plan as per Rule-15 of the Ammonium Nitrate Rules-2012 and the conditions endorsed on the licence.
            7. Fire Hydrants should be located in the selected areas with the help of fire officer. The Fire Department and Delhi Jal Board may be associated to ensure that the location is satisfactory, adequate water pressure is maintained and is usable when it is required.
            8. Ammonium Nitrate shall not be used for display.
            9. No licencee shall provide false or misleading information or declaration in any application made or statement submitted under these rules.
            10. No licencee shall falsify, erase or fraudulently alter any entry in any log book, document or other record required to be kept or maintained under these rules.
            11. No licencee shall change or alter any license or other documents under the Ammonium Nitrate Rules.
            12. The transport of Ammonium Nitrate in sensitive areas shall not be allowed during the period from sunset to sunrise. The movement of Ammonium Nitrate and the particulars of the origin and the destination of the consignment shall be informed to the concerned police authorities in writing.
            13. No licencee shall sell the Ammonium Nitrate from the pavement or any place outside of storehouse. Neither any licencee shall encroach the pavement or the abutting road with the goods/ Ammonium Nitrate bags nor will he place any sale counter on the pavement or the road.
            14. The licensee shall intimate in writing of any loss or theft involving the Ammonium Nitrate or Ammonium Nitrate melt in his possession where the loss exceeds the permitted limit of loss that typically occurs during routine productions, storage, transportation of use of Ammonium Nitrate to the licensing authority and concerned district authority giving details of circumstances leading to loss or theft and same to the concerned police station.

            Role and functions of Addl. CsP/ DCsP of the district:-

            Apart from ensuring that all the terms and conditions laid down in the Ammonium Nitrate Rules-2012 are followed, the following specific role and functions have been given to the district Addl. CP/DCP and police station under the Rules to ensure that:-

            Maintenance of Records and submission of returns:-

            1. The licencee shall maintain the record in the prescribed forms and submit the monthly returns of Ammonium Nitrate manufactured, converted, stevedored, received, sold, transported, used, destroyed or imported or exported to the licensing authority, Additional CP/Licensing and concerned district DCsP in the (Annexure-H, H-1 and H-2 Click to Download) prescribed forms as per part 3 of Schedule II of Rule 50 of Ammonium Nitrate Rules, 2012 duly certified by the competent authority to ensure accountability, identification and traceability of Ammonium Nitrate and shall produce such records on demand to the competent authority.
            2. The stock books in the forms specified shall be page numbered and certified by any officer authorised under these rules and such records shall be retained for a period of three years, unless otherwise directed by an authority.
            3. The licensee shall submit monthly returns of the Ammonium Nitrate manufactured, converted, stevedored, received, sold, transported, used, destroyed or imported or exported to the licensing authority i.e. Addl. CP/Licensing, District DCP in the prescribed form so as to reach the above authority on or before the 10th of every succeeding month.
            4. The licence holder shall maintain record and make transaction and file returns by electronic means when directed by the licence issuing authority.

            Transportation of Ammonium Nitrate:-

            1. Every consignment of Ammonium Nitrate or Ammonium Nitrate Melt transported shall be accompanied by a pass issued by the consignor in Form R-11(b) (Annexure-L, Click to Download).
            2. The pass referred above shall be attached to the way-bill, invoice or bill of entry or despatch note as the case may be.
            3. Intimation in Form R-11(a) shall be sent by the consignor at least twenty four (24) hours in advance to the District Superintendent of Police/District Dy. Commissioner of Police of place of dispatch as well as to the District Superintendent of Police/Dy. Commissioner of Police of place of receipt.
            4. A copy of every pass issued under (a) above shall forthwith be sent by the consignor to:-
              1. The Licensing Authority who issued the licence of the consignor
              2. The District Authority having jurisdiction of the place of dispatch
              3. The District Superintendent of Police/Dy. Commissioner of Police, in whose jurisdiction the place from which the consignment is sent is situated
              4. The District Superintendent of Police/Dy. Commissioner of Police in whose jurisdiction the place to which the consignment is sent is situated.
            5. The Ammonium Nitrate of Ammonium Nitrate Melt shall be transported only by consignors holding valid licence in Form P-4.
            6. The tanker for transportation of Ammonium Nitrate melt shall be constructed of stainless steel, as approved by the Controller of Explosives. The tanker should not exceed the maximum load limit prescribed by the Road Transport Authority. The design of inlet/outlet valves and vent pipes should be so designed to prevent pilferage of the product.
            7. Ammonium Nitrate shall not be transported along with any other material including hazardous material.
            8. The Ammonium Nitrate shall be transported duly secured vehicles and covering by layers of tarpaulin under the seal of the transport license holder and it shall be ensured that the driver or any attendant thereof has in his possession the copy of indent in Form R-10 issued by the consignee, copy of transport pass in Form R-11 (b) issued by the consignor and the original copy of bill or bill of entry of Ammonium Nitrate being transported. These documents shall be produced by the transporters on demand by the authority.
            9. The consignor shall ensure delivery of consignment of Ammonium Nitrate to storehouse of the consignee at the declared destination and the Form R-11(b) duly acknowledged by the consignee be retained as recode by the consignor.
            10. The vehicles engaged in transport of the Ammonium Nitrate shall be attended by only such drivers or cleaners, whose antecedents are verified by the local police and a list of such drivers or cleaners along with all personal particulars should be made available to the local police in advance to carry out the verification and the re-verification of such drivers or cleaners should be carried out at regular intervals, once in five years.
            11. The vehicles carrying Ammonium Nitrate shall be accompanied by at least two able bodied guards and the vehicle shall not be stop for a longer period than is reasonably required, and shall avoid stops at places where public safety is likely to be in danger. In case of parking of the vehicle due to break down etc., the local police shall be informed.
            12. A vehicle while transporting Ammonium Nitrate shall be adequately secured at the expense of the licence holder and if the consignment of Ammonium Nitrate is likely to pass through sensitive areas notified by MHA, it should be escorted by armed police escort or guard, provided by the district police. The transport of Ammonium Nitrate in sensitive areas shall not be allowed during the period from sunset to sunrise. The movement of Ammonium Nitrate and the particulars of the origin and the destination of the consignment shall be informed to the concerned police authorities in writing.
            13. Every vehicle transporting Ammonium Nitrate shall be provided with two fire extinguishers of ISI Mark in good working conditions of minimum five Kilogrammes capacity and one of the extinguishers shall be capable of dealing with fire involving electric circuits and the other, with other inflammable components.
            14. Nothing contained in Rules 20, 21, 22 and 23 shall be applicable for transport of solid Ammonium Nitrate, possessed/purchased by persons permitted/holding valid licence under these rules for quantities not exceeding 50 kilograms.
